Bihar Chief Minister Nitish Kumar is expected to resign from the Bihar Legislative Council on March 30, following his recent election to the Rajya Sabha. The move comes in compliance with constitutional provisions that prohibit simultaneous membership in Parliament and a state legislature.
Nitish Kumar was elected to the Rajya Sabha earlier this month. According to constitutional rules, any member of a state legislature elected to Parliament must resign from their state post within 14 days of election.
A senior Janata Dal (United) [JD(U)] leader confirmed that the Chief Minister would submit his resignation before the deadline.
Constitutional Requirement
Under the Prohibition of Simultaneous Membership Rules, 1950, framed under Articles 101 and 190 of the Constitution, legislators cannot hold memberships in both Parliament and a state legislature simultaneously. March 30 marks the final date for submitting resignations in such cases.
Nitin Nabin Also Expected to Resign
Meanwhile, BJP national president Nitin Nabin, who was scheduled to resign from the Bihar Legislative Assembly earlier, is also expected to step down today. Preparations for both resignations have reportedly been completed at the Assembly Secretariat.
Nabin had planned to resign on Sunday but left for Delhi due to urgent commitments, delaying the process.
Speculation Over Bihar’s Political Future
The developments have intensified political discussions regarding a possible leadership change in Bihar. Reports suggest increased lobbying within the Bharatiya Janata Party (BJP), with indications that the party may consider appointing its own Chief Minister for the first time in the state.
Sources within the BJP hinted that a future Chief Ministerial candidate could come from a Rashtriya Swayamsevak Sangh (RSS) background.
Nitish Kumar’s Political Position
After the 2025 Bihar Assembly elections, where the NDA secured a landslide victory, Nitish Kumar took oath as Chief Minister for a record tenth term. However, political observers believe he may have to relinquish the post within months amid changing alliance dynamics.
Last week, JD(U) national working president Sanjay Kumar Jha stated that while the timeline for Nitish Kumar stepping down as Chief Minister remains unclear, he would resign from the Legislative Council before the constitutional deadline.
Assembly Developments
Bihar Assembly Speaker Prem Kumar had briefly travelled to Delhi but returned to Patna after being informed that Nitin Nabin intended to resign. However, the resignation was postponed due to unavoidable reasons, leaving political uncertainty ongoing.
