Supreme Court Orders Equal DA and DR for Pensioners

The Supreme Court of India Judgment on Dearness Allowance and Dearness Relief has delivered a significant verdict on Dearness Allowance (DA) and Dearness Relief (DR), stating that governments cannot discriminate between employees and pensioners while granting inflation-linked benefits.

A bench of Justice Manoj Misra and Justice Prasanna B. Varale dismissed appeals filed by the Government of Kerala and the Kerala State Road Transport Corporation, reinforcing the principle of equality for retired employees.

The court observed that inflation impacts both serving employees and retired pensioners equally. Therefore, denying equal benefits or applying different rates would be arbitrary and discriminatory.

In its ruling, the Supreme Court emphasized that equality is a dynamic constitutional concept and cannot be restricted within traditional boundaries. The bench further clarified that pensioners are entitled not only to pension benefits but also to Dearness Relief (DR), which is periodically revised based on inflation levels.

The court stated that the core issue was not entitlement to benefits, but the unequal application of rates between active employees and retirees. It concluded that when both DA and DR are linked to inflation and serve a common purpose, applying different rates is unjust and violates the principle of equality.

This judgment is expected to have wider implications for pension policy and government employees across India, especially in cases involving inflation-adjusted allowances.
