HPNLU Hosts Lecture on Retrospective Tax Policy

The Centre for Business Law and Economics at Himachal Pradesh National Law University (HPNLU) successfully organized a special lecture titled “Spill-Over Effects of Retrospective Taxation Policy Under International Investment Agreements.” The event was held under the leadership of Vice-Chancellor Prof. (Dr.) Preeti Saxena.

The lecture was delivered by noted international economic law expert Dr. Argha K. Jena, who specializes in international dispute resolution and international economic law. The session witnessed active participation from LL.M. students and undergraduate students of the 8th and 10th semesters, particularly those specializing in Business Law.

Drawing upon over a decade of professional experience, Dr. Jena provided a detailed and insightful analysis of the legal and economic implications of retrospective taxation measures under international investment treaties. He discussed treaty obligations, arbitral interpretations, sovereign taxation powers, and the broader policy consequences arising from retrospective tax measures adopted by sovereign nations.

Dr. Jena is the Co-Founder of Transnational Legal Advisors (TNLA) and previously served as Senior Legal Consultant in the Department of Economic Affairs under the Ministry of Finance, Government of India, where he played a significant role in international investment treaty negotiations.

The lecture offered valuable insights into contemporary developments in international taxation and investment law, with a special focus on spill-over effects such as investor confidence, treaty arbitration exposure, and balancing sovereign taxation powers with international commitments.

An interactive session followed the lecture, allowing students to engage in meaningful discussions on investor-state dispute settlement (ISDS), treaty interpretation, and policy reforms.

The Centre for Business Law and Economics expressed gratitude to Dr. Jena for sharing his expertise and enriching academic discourse at the university.
